GENERAL CONTEST RULES

Applicable to all contests, on air and in person

Except as set out in the specific terms published for an individual contest, these General Contest Rules apply to and govern every contest, sweepstakes, giveaway, drawing, game, and promotion conducted by On-Air Sports Marketing, LLC (“OASM”). Where the specific terms for an individual contest differ from these General Contest Rules, the specific terms govern and control that contest only, and these General Contest Rules continue to govern in all other respects.

Who Runs These Contests

  1. All contests governed by these rules are sponsored, administered, operated, judged, and fulfilled solely by On-Air Sports Marketing, LLC, an Arizona limited liability company, together with the participating advertiser or promotional partner identified for a given contest (each, a “Sponsor”).

THESE CONTESTS ARE NOT SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED IN ANY WAY WITH ESPN, ESPN RADIO, 620 AM, 98.7 FM HD-2, BONNEVILLE INTERNATIONAL CORPORATION, OR ANY OF THEIR PARENTS, SUBSIDIARIES, AFFILIATES, LICENSORS, ADVERTISERS, AGENTS, OR EMPLOYEES.

  1. “Roc and Manuch with Jimmy B” is an independently produced program of OASM. The parties named in the box above (collectively, the “Broadcaster Parties”) provide broadcast distribution only and have no responsibility, obligation, or liability of any kind with respect to any contest governed by these rules, its administration, its judging, its prizes, or the award and delivery of any prize. All questions, comments, disputes, and claims must be directed to OASM and must not be directed to the Broadcaster Parties, to any station studio, or to any station phone number.
  2. These contests are not affiliated with, sponsored by, endorsed by, or administered by any professional or collegiate sports league, conference, member club or franchise, players association, or athlete. No such name, mark, logo, or uniform may be used in contest promotion or prize description without a written license on file with OASM.

Who Can Enter

  1. Entry is open only to individuals who, as of the date of entry, are (i) 18 years of age or older and (ii) legal residents of the State of Arizona (each, an “Entrant”). Where a contest is identified as alcohol-related, casino-related, or gaming-related, the minimum age is 21. Where the specific terms for a contest state a higher minimum age, that age controls. Contests are offered only within the State of Arizona and are not open to residents of any other state or jurisdiction.
  2. Notwithstanding Section 4, the following individuals are not eligible to enter or to win, even where they meet the age and residency requirements:
  3. Any employee, owner, member, officer, director, contractor, on-air talent, or sales representative of OASM, of any participating Sponsor, of any prize provider, of any advertising or promotional agency involved in the contest, or of any of the Broadcaster Parties, and of the respective parent entities, subsidiaries, and affiliated companies of each;
  4. Any immediate family member of any such individual, including without limitation a current or former spouse, domestic partner, parent, grandparent, child, grandchild, sibling, in-law, or step-relation in any of the foregoing categories; and
  5. Any other individual residing at the same address as any such individual, including without limitation roommates, housemates, significant others, and partners, whether or not related.
  6. Limit one entry per person per contest, and one prize per person and per household in any thirty (30) day period, unless the specific terms for a contest state otherwise. Entries submitted by an agent, a third party, an entry service, or any script, bot, or automated method, and duplicate entries submitted under multiple names, phone numbers, email addresses, or accounts, are void. Void where prohibited.

How to Enter and How to Win

  1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
  2. For each individual contest, OASM will provide the following contest-specific information as applicable (the “Contest Terms”): (i) when to enter and the deadline for entering (the “Entry Period”); (ii) how to enter, which may include one or more of the entry methods described below; (iii) the times, dates, locations, and methods for selecting qualifiers, finalists, winners, and grand prize winners as applicable; and (iv) a description and approximate retail value of the prize or prizes to be awarded.
  3. OASM may provide Contest Terms by any one or more of the following means: on-air announcement, website post, email, text message, social media post, podcast, or on-site poster, display, handout, or other material at a live broadcast, remote, or partner location.
  4. Any reference to information being “announced” or “as announced” means that OASM has provided or will provide that information by any one or more of the foregoing means, as OASM determines for each contest.
  5. Except where required by these rules, by the specific terms for a particular contest, or by the nature of the contest itself, Contest Terms are not required to be announced on the radio.
  6. OASM is not responsible for the failure of any third-party sponsor, venue, or location to make Contest Terms available, to display contest materials, or to keep entry materials in stock.
  7. Free alternate method of entry. No purchase, payment, entry fee, or other consideration is required to enter or to win. Any contest in which a winner is determined by chance offers the following free method of entry, which carries equal weight and equal odds with every other method of entry for that contest. Hand-print your full name, complete street address, city, state, ZIP code, daytime telephone number, email address, and date of birth on a plain 3″ x 5″ card, and mail it in a hand-addressed #10 envelope with proper first-class postage to the OASM office address on page one, identifying the contest by name. Limit one mail-in entry per outer envelope; each entry must be mailed separately. Mail-in entries must be postmarked and received within the Entry Period announced for that contest. Mechanically reproduced entries are void. OASM is not responsible for lost, late, illegible, postage-due, or misdirected mail.
  8. On-air contests generally.
  9. WARNING: Because of the delay inherent in online and mobile app streaming of the broadcast signal, listeners to any stream may be unable to participate in, or may be significantly disadvantaged in, any contest that requires listening to the program. Contest participants should not rely on a streamed broadcast.
  10. IMPORTANT: Only calls placed to the contest phone number announced for that contest will be accepted. Calls placed to any other number, including any station main line, studio line, or business line, will not be accepted, and OASM is not responsible for calls mistakenly placed to any other number.
  11. If a caller is disconnected, fails to complete the call, or is found to be ineligible, the next eligible caller who successfully reaches the contest line and completes the call will be the winner.
  12. If OASM receives fewer than the designated number of calls within a reasonable period of time as determined by OASM — for example, only nine callers where the tenth caller was to win — OASM reserves the right to re-conduct that contest at a later time or to cancel that winning opportunity and not award the associated prize.
  13. Calls placed to the show line may be recorded and broadcast. By calling, you consent to that recording and broadcast.
  14. Designated caller contests. Listen for the on-air announcement, instruction, or sounder specifying the designated caller number, the contest phone number, and the prize. Upon hearing it, be the designated caller to the announced number to win the announced prize or to qualify for a later drawing, as announced.
  15. Trigger contests. Listen for OASM to announce a specific recurring segment, sounder, bed, drop, phrase, song, or combination of the same, along with the days and the times or time ranges during which that element will constitute a valid trigger, and the designated caller or text number for the chance to win when the trigger occurs.
  16. OASM begins accepting entries as soon as the designated element begins to air, or in the case of a required combination, as soon as the final required element begins to air.
  17. To be a valid trigger, the element must air in full on the program, at the times or within the time ranges and on the days announced. A partial airing, a clip, or the use of the element inside a promotional announcement, imaging element, or advertisement is not a valid trigger unless expressly announced as one.
  18. Where the announcement specifies that only the first occurrence on a given day is a valid trigger, no later occurrence that day is a valid trigger.
  19. Listen for your name contests. Where a contest requires a selected Entrant to listen for his or her own name to be announced on air as a potential winner, only the actual individual who entered may win, and that individual must personally place the call. A person with the same name who did not enter will be disqualified. The selected Entrant must call only the announced contest phone number, and that call must be received and answered within the exact window of time announced.
  20. Question and trivia contests. Where a contest is won by answering a question, the question, the time allowed, and the number of attempts permitted will be announced. The answer source is determined by OASM at the time the question is asked. If a question is later found to be ambiguous or to have more than one defensible correct answer, OASM will honor all defensible answers. If no Entrant answers correctly within the announced window, OASM may extend the window, offer a clue, roll the prize to a later contest, or award no prize.
  21. Text contests.
  22. Entrants may receive a confirmation text acknowledging entry. OASM does not charge a fee for this service. Standard message and data rates may apply and are the Entrant’s responsibility. Message frequency varies and messages are recurring. Consent to receive messages is not a condition of entry or of any purchase. Reply STOP to cancel; reply HELP for help. OASM assumes no responsibility for charges incurred for text messaging.
  23. Messages sent to any short code other than the announced short code, messages containing any keyword other than the announced keyword, and messages sent without a keyword will not be accepted as entries. OASM is not responsible for messages mistakenly sent elsewhere, for delivery failures, or for carrier delays.
  24. Where a keyword is announced, text it during the announced window, until the announced time, or until OASM receives the designated entry. In the event of a service interruption, delivery failure, or ineligible Entrant, the next eligible Entrant wins. If OASM receives fewer than the designated number of texts within a reasonable period of time, OASM may re-conduct that contest later or cancel that winning opportunity and not award the prize.
  25. Where a keyword must be obtained by visiting a participating Sponsor location, that location must be visited during its own regular business hours, which vary by location. OASM has no obligation or liability if a keyword or short code is obtained from a third party rather than by visiting the location. Unless expressly stated for a given contest, OASM will not post entry keywords online or on social media and will not provide entry keywords over the telephone.
  26. Online contests. Enter by visiting the website announced for the contest, following the links and instructions, and completing and submitting the entry form during the Entry Period. The form may require contact information and may additionally require answering survey or trivia questions, making a prediction, or submitting entry materials.
  27. Entrants may be offered the opportunity to opt in to OASM or Sponsor email lists, text clubs, or rewards programs as part of the entry process. Opting in is never required in order to enter.
  28. Where a contest offers additional entries for completing a survey, opting in, or referring a friend who validly enters, the total number of additional entries available to any Entrant is capped at the number announced.
  29. Where entry requires an account with a third-party contest software provider, that provider is not a sponsor of the contest. Its terms of service and privacy policy are a separate agreement between the Entrant and that provider and are not part of these rules; where they conflict, these rules govern. OASM is not responsible for any error or technical malfunction of that provider’s platform. Employees of that provider and their immediate family members are not eligible to win.
  30. Social media contests. Where entry is made through a social media platform, the Entrant must post exactly as instructed, including the unique hashtag announced for that contest and, where required, the OASM account handle. A post that omits or alters the required hashtag or handle will not be accepted as an entry. Posting correctly does not by itself guarantee a valid entry; OASM may exclude any post that fails to comply with any contest requirement.
  31. No social media platform is a sponsor, endorser, or administrator of any contest governed by these rules, and no platform is affiliated with OASM or its contests in any way. By entering through a platform, the Entrant releases that platform completely and understands that all questions must be directed to OASM and not to the platform.
  32. By entering through a platform, the Entrant authorizes OASM to access and use applicable portions of the Entrant’s public profile information for contest administration. Entry information submitted through a platform is provided to OASM, not to the platform operator.
  33. OASM cannot control platform errors, account cancellations, or technical malfunctions that may affect an Entrant’s ability to enter, win, view, or be considered in a contest, and is not responsible for them. Employees of any platform and their immediate family members are not eligible to win.
  34. On-site and entry box contests. Entries must be deposited in the official entry container by the announced deadline. Only official entry forms completed legibly by hand are eligible; mechanical reproductions are not accepted. Official entry forms are available only at the location of the official entry container, while supplies last. Failure to provide all required information may result in disqualification.
  35. In-person games and physical attempts. For any contest decided by a physical attempt — including without limitation a dice roll, putt, shot, throw, kick, or timed challenge — the number of attempts, the equipment, the distance or dimensions, the time limit, the required witnesses, and the standard for a successful attempt will be announced or posted before the attempt is made and will not be altered during the contest.
  36. The ruling of the OASM judge on site is final and is not appealable. There are no re-attempts, do-overs, or practice attempts unless expressly announced in advance.
  37. A participant must follow all instructions given by OASM staff and by venue staff. Any intentional failure to comply with instructions, procedures, or contest rules may result in immediate disqualification at OASM’s sole discretion.
  38. Where a prize is covered by a prize indemnity policy, the attempt must be conducted and witnessed exactly as that policy requires, and no element of the announced mechanic may be altered.
  39. Entry materials. Where a contest requires an Entrant to submit an essay, photograph, video, or other content (“Entry Materials”), the Entrant must be 18 or older and must either exclusively own the Entry Materials or have obtained a license from the copyright holder permitting entry and permitting OASM’s use as described in these rules.
  40. Entry Materials must not contain content that OASM determines, at its sole discretion, to be indecent, profane, obscene, sexually explicit, threatening, abusive, harassing, defamatory, vulgar, or hateful; to be racially, ethnically, or otherwise offensive; to encourage unlawful behavior; to infringe any third party’s intellectual property; or to disclose personal or confidential information belonging to a third party. OASM is not required to apply this standard identically to every submission.
  41. Only the Entrant may be depicted or captured in a submitted photograph or video. No other person’s image, voice, or likeness, and no third-party performance or copyrighted work, may be captured. OASM may in its discretion accept a submission in which another person is present but indistinguishable and immaterial, and may in its discretion obscure third-party marks; OASM is obligated to do neither and is not obligated to treat every submission the same way.
  42. Where a word limit is stated, OASM is obligated to read and consider only up to that limit. OASM may edit any submission at its sole discretion and may post or feature any submission on its website or social media accounts. Being featured does not mean an Entrant has won or is likely to win and is not part of the winner selection process.
  43. OASM cannot guarantee that it will be able to open or view every submission, even where submitted in a required format. A submission OASM cannot open may be disqualified without notice, and OASM has no liability to that Entrant.
  44. Contest events and check-in. Where a contest requires an Entrant or qualifier to appear at a live broadcast, remote, or other event in order to continue participating:
  45. The individual must check in, or be in line to check in, by the announced time. Check-in may require completing and signing one or more releases, presenting valid government-issued photo identification, and providing a Social Security number or taxpayer identification number. Failure to complete any required step at check-in results in automatic disqualification.
  46. If an event must be rescheduled for any reason, the change will be announced on air and posted online. It is each participant’s responsibility to check for cancellation or rescheduling information. OASM may, but is not obligated to, attempt individual notice, and has no liability if any individual does not receive it.
  47. OASM has no liability or responsibility for any individual’s inability to attend on a rescheduled date, and no alternative opportunity or substitute prize will be offered.
  48. On-air commentary. By entering, each Entrant understands and accepts that hosts and staff may comment on, discuss, react to, poke fun at, or imitate any entry, answer, attempt, or performance on the air or online. Each Entrant waives any claim against OASM, the Sponsors, and the Broadcaster Parties arising from any such comment, whether disparaging or otherwise, and from any use of the Entrant’s voice, appearance, entry, or participation. All entries and Entry Materials become the property of OASM and will not be acknowledged or returned.
  49. Identity disputes. In the event of a dispute over the identity of an Entrant, the Entrant is the single individual who can demonstrate control over the means by which the entry was submitted — by logging into the account used to enter with the correct credentials, or by evidencing ownership of the telephone number from which a text entry was sent. For mail-in and on-site entries, the Entrant is the individual named on the entry.
  50. Tampering and misconduct. Any individual found to be, or reasonably suspected of, tampering with a contest — including by submitting a fraudulent or incomplete entry, using any automated or pre-programmed method of entry, engaging in deal-making with or between other participants or third parties, cheating, creating a public hazard, interfering with or damaging property, or consuming public safety resources — will be disqualified from participating and from winning any prize, and may be banned from all future contests, whether for a fixed period or permanently, as OASM determines case by case.
  51. Contact and notification. OASM may contact Entrants, qualifiers, and winners by phone, email, text message, direct message or public post on social media, or in person. OASM is required to make only one contact attempt — one voicemail, one email, one text, one direct message, or one public post. OASM may in its discretion attempt contact more than once but is not required to make an equal number of attempts, or attempts by the same method, for every individual.
  52. Sole arbiter. OASM is the sole arbiter in all matters relating to its contests, including all matters of entry validity and the interpretation of these rules and any Contest Terms. All OASM decisions are final and are not appealable. Entry constitutes agreement to abide by these rules and by any additional rules established by OASM.

Prizes

  1. Prizes are released to verified winners only. Prizes are not mailed unless OASM determines otherwise in its sole discretion. Prizes must be picked up at the OASM office address on page one during the hours stated there, unless OASM directs otherwise. A prize not claimed within thirty (30) business days after the winner is advised it is available — or, for a time-sensitive prize, within its period of usability if shorter — is forfeited without further notice, becomes the property of OASM, and may be disposed of as OASM determines.
  2. Notwithstanding anything stated on air, published online, or contained in any contest material, no potential winner is entitled to receive any prize until OASM has verified that individual’s eligibility and compliance with these rules and the applicable Contest Terms, and until that individual has completed and submitted every document OASM requires.
  3. A potential winner may be required to present valid government-issued photo identification, to provide a valid Social Security number or taxpayer identification number, and to complete and sign an affidavit of eligibility, a liability release, and a publicity release.
  4. Any individual who refuses to present identification, to provide a taxpayer identification number where required, or to complete any required document by the deadline OASM sets forfeits any and all prizes.
  5. OASM reserves the right to examine identification and may reasonably choose to accept or decline to award a prize based on the identification presented.
  6. Where any Entrant, qualifier, or winner is disqualified for any reason permitted by these rules, at any point before or after a winner is determined: (i) OASM and the Sponsors are not obligated to notify that individual of the disqualification or forfeiture; and (ii) OASM is not obligated to select an alternate, and may instead retain the associated prize as its own property or dispose of it as it sees fit.
  7. Unless the Contest Terms state otherwise, the following restrictions apply to prizes:
  8. Prizes are awarded AS IS and WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Manufacturer warranties, where they exist, pass to the winner.
  9. Alcoholic beverages will not be awarded as a prize or as any component of a prize unless expressly cleared in writing in advance, and no contest mechanic may involve, depict, reward, or encourage the consumption of alcohol.
  10. Any prize consisting of tickets or admission is subject to the terms, conditions, and restrictions imposed by the venue, team, promoter, or issuing party. OASM is not responsible for the cancellation, postponement, relocation, or alteration of any event and has no obligation to substitute a prize in that circumstance.
  11. Any prize consisting of an opportunity to meet, interview, or otherwise interact with any athlete, coach, broadcaster, or other public figure other than OASM personnel is contingent on that individual appearing, which is outside OASM’s control. If that individual does not appear or cannot participate for any reason — including injury, illness, trade, release, roster move, team or league restriction, scheduling conflict, or act of God — OASM is not responsible for that portion of the prize, which carries no monetary value, no alternate prize will be awarded, and the activity will not be rescheduled.
  12. Any prize including travel or overnight accommodations is subject to availability and to the additional restrictions imposed by OASM, the Sponsor, and any travel provider, including blackout dates, peak period restrictions, expiration dates, and additional age requirements for the winner and any guest. Restrictions are not negotiable. Guests may be required to sign releases. Winner and guest must travel on the same itinerary, which may not be changed once booked. Accommodations are standard double occupancy. The winner is solely responsible for ground transportation, meals, gratuities, incidental expenses, items of a personal nature, and all taxes, fees, and charges, and may be required to present a valid credit card at check-in.
  13. Any gift card or gift certificate may be subject to expiration dates, designated locations, availability, blackout periods, and excluded items such as tax, gratuity, alcoholic beverages, or particular goods, and is redeemable only at the locations for which it is specified.
  14. Any cash prize is fulfilled by company check payable to the verified winner only, made available approximately six (6) to eight (8) weeks after the winner completes and submits all required documents.
  15. OASM and the Sponsors are not responsible for replacing or compensating a winner for any event, flight, or activity that is canceled, delayed, or rescheduled, all of which are deemed beyond OASM’s control, and are not responsible for any expense a winner incurs as a result. This includes work stoppages, labor disputes, lockouts, bankruptcy, and any other condition beyond OASM’s control affecting its ability to provide a prize.
  16. All expenses and items not expressly described as part of the prize are the winner’s sole responsibility. Any difference between actual value and the stated approximate retail value will not be awarded.
  17. Except by OASM, which reserves the right to substitute any prize or prize component with one of equal or greater value, prizes may not be redeemed for cash, substituted, transferred, or assigned. Winners are prohibited from selling any prize or transferring any prize without OASM’s written authorization, which OASM may grant or withhold case by case at its sole discretion. Where OASM discovers or suspects, correctly or incorrectly, that a winner is attempting to resell a prize — including through any online marketplace or ticket resale platform — OASM may, at its sole discretion, disqualify the winner and deem the prize forfeited, decline to award the prize even where the winner represents that it will not be resold, and ban the winner from participating in or winning any future contest, for a fixed period or permanently. OASM may track, cancel, and invalidate any prize it suspects was sold or transferred without authorization.
  18. Taxes. Winners are solely responsible for all federal, state, county, and local taxes on prizes, based on the approximate retail value stated in the Contest Terms. Where the aggregate value of all prizes won by an individual from OASM in a calendar year is $600 or more, that individual must furnish a completed and signed IRS Form W-9 before any prize is released and will be issued an IRS Form 1099-MISC. Failure to provide a completed Form W-9 within the deadline OASM sets results in forfeiture.

Other Rules Applicable to All Contests

  1. Odds. Odds of winning depend on how the contest is conducted. For a random drawing, odds depend on the number of eligible entries received. Where qualifiers are entered into a later drawing, odds depend on the number of qualifiers. For a contest of skill involving no element of chance, odds are not applicable. Tie-breaking procedures will be published in the Contest Terms or on the OASM website.
  2. Voting. Where a contest involves voting: (i) unless announced otherwise, voting is for entertainment purposes only and is not the determining factor in selecting a winner, though OASM may consider it as one factor among several; (ii) age and residency requirements do not apply to voters; (iii) OASM may, but is not obligated to, post an in-process tally, which will not be real time, may be discontinued at any time, may not be relied upon, and is not binding on OASM; and (iv) OASM may end voting before the announced closing date by posting at least twenty-four (24) hours’ notice online.
  3. The use of robotic, mechanical, automated, or otherwise pre-programmed methods of entry, voting, or site visits is PROHIBITED, and any entry or vote so submitted is void.
  4. OASM may implement measures to frustrate or block automated entry or voting, including CAPTCHA, account registration, email verification, per-period caps on entries or votes from a single source, and the blocking of a particular IP address or telephone number for a contest, for a period, or permanently. OASM is not required to disclose the thresholds it applies.
  5. OASM may install and access cookies and may log IP addresses to measure traffic, monitor entry and voting frequency, and detect or prevent automated activity.
  6. Inquiries. OASM may or may not respond to inquiries about the status of an entry or about a contest, by any means, and is not obligated to respond to or to treat all inquiries identically, even where the question is identical. The sole authoritative source of information about any contest is these rules together with the Contest Terms for that contest. Nothing communicated by any OASM employee in response to an inquiry is binding on OASM or constitutes an advantage to any Entrant.
  7. Publicity. Participation in a contest and acceptance of a prize constitutes each Entrant’s, winner’s, and winner’s guest’s consent for OASM and its designees to interview, photograph, film, and record that individual, and to use in commerce, in any medium now known or later developed, throughout the world, in perpetuity, and without notice, approval, or additional compensation: that individual’s name, hometown, biographical information, likeness, photograph, audio or video recording, Entry Materials, prize information, and any statement made regarding OASM, the contest, or its Sponsors, for purposes of trade, publicity, or promotion, except where prohibited by law.
  8. Release and indemnity. Participation in a contest and acceptance of a prize constitutes each Entrant’s, winner’s, and winner’s guest’s agreement to release, forever discharge, indemnify, and hold harmless OASM, the Sponsors, each prize provider, each participating venue, the Broadcaster Parties, and their respective parents, affiliates, successors, assigns, owners, officers, directors, members, managers, employees, contractors, and agents, and all others connected with the contest or event (collectively, the “Released Parties”), from any and all liability, claims, actions, and damages sustained or incurred in connection with participation in the contest or event and with the receipt, possession, or use of any prize, arising in any manner whatsoever, including by act or omission, whether negligent, intentional, or otherwise. Where a contest is administered in whole or in part through a social media platform, this release and indemnity extends to that platform in the same manner.
  9. Participation in any in-person contest activity is voluntary and undertaken at the participant’s own risk.
  10. To the fullest extent permitted by law, the Released Parties’ total aggregate liability to any Entrant is limited to the actual value of the prize at issue, and in no event will the Released Parties be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for attorneys’ fees.
  11. The Released Parties are not responsible for: typographical or other errors in the printing, offering, or administration of a contest or in the announcement of a prize; incorrect or inaccurate information, human error, failure, or omission; unauthorized human intervention; lost, stolen, mangled, misdirected, illegible, incomplete, or late entries; entries not received because of difficulty accessing the internet, service outages or delays, computer or device difficulties, or other technological problems; telephone or mobile network outages, delays, busy signals, poor or interfering signals, accidental disconnection, or equipment malfunction; or any cancellation, delay, diversion, substitution, or omission by any transportation, venue, or service provider. The Released Parties are further not responsible if any part of a contest cannot be conducted or any prize cannot be awarded because of acts of God, acts of war, natural disaster, weather, acts of terrorism, public health emergency, or other factors beyond their control.
  12. If for any reason a contest cannot be conducted as planned — including because of computer virus, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond OASM’s control that corrupts or affects the security, administration, fairness, integrity, or proper conduct of the contest — OASM reserves the right to cancel, terminate, suspend, or modify the contest without prior notice. Where a contest is terminated before its scheduled end, OASM reserves the right in its sole discretion to modify the procedure for selecting winners and to award prizes from among eligible non-suspect entries received before the impairment, unless the nature of the event makes selecting a winner impossible.
  13. Privacy. Any reference to a privacy policy in contest materials or advertising refers to the OASM privacy policy available on the OASM website. OASM may use cookies and collect IP addresses in order to administer contests, exercise its rights under these rules, and for other lawful purposes consistent with that policy. Information collected in connection with entering, voting, or otherwise participating in a contest is used to administer the contest, verify eligibility, award prizes, and satisfy tax reporting obligations, and may be shared with the Sponsor and prize provider for those purposes and, where an Entrant has separately opted in, for that party’s marketing. OASM does not sell Entrant personal information.
  14. Not a lottery or gambling activity. No purchase, payment, entry fee, wager, bet, stake, or other consideration is required to enter or to win. Contests governed by these rules are not lotteries, raffles, gambling activities, amusement gambling activities, or games of chance for consideration within the meaning of Arizona Revised Statutes Title 13, Chapter 33, or any other applicable law. Where a contest is presented with a gaming or casino partner, it is free to play, no mechanic involves placing or simulating a wager on the outcome of any real sporting event, and the responsible-gaming disclosure required by that partner will be provided.
  15. Governing law and disputes. All questions concerning the construction, validity, interpretation, and enforceability of these rules and the rights and obligations of Entrants and OASM are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Each Entrant consents to exclusive jurisdiction and venue in the state or federal courts located in Maricopa County, Arizona, agrees that any dispute will be resolved individually and not through any form of class action, and agrees that any remedy is limited to actual out-of-pocket costs incurred, excluding attorneys’ fees. Contests are subject to all applicable laws and regulations and are void where prohibited.
  16. Winners list. For a list of winners for a particular contest, mail a self-addressed stamped envelope to the OASM office address on page one, identifying the contest by name. Requests must be mailed and received after the contest has concluded and no later than three (3) months after its conclusion.
  17. Conflicts. In the event of any discrepancy between these General Contest Rules and any advertisement, on-air announcement, social media post, or other contest material, these General Contest Rules, as modified by the applicable Contest Terms, govern.
