PROMOTION DESCRIPTION: The “FAN-TASTIC TAILGATING SWEEPSTAKES” (“Sweepstakes”) begins on August 19, 2024 at 9:00am PST and ends on January 30, 2024 at 3:00 pm PST (the “Promotion Period”). The sponsor of this Sweepstakes is On-Air Sports Marketing dba Roc and Manuch with Jimmy B on Fox Sports 910. (“Sponsor”) in partnership with Twin Peaks Arizona and their five locals (“Partner”). This promotion is not affiliated with Instagram, Facebook, Twitter, Fox Sports 910 KGME or IHeartradio. By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Entrants should look solely to the Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at [email protected] during the Promotion Period.

ELIGIBILITY: Open to legal residents of Arizona who are at least eighteen (18) years of age at entry (the “Entrant”). Sponsor and Partner, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors, and associates (the “Promotion Entities”), are ineligible to enter the Sweepstakes or win a prize. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

Only one (1) prize package per person and per household will be awarded. Gift cards and gift certificates are subject to the terms and conditions of the issuer. Prizes cannot be transferred, redeemed for cash or substituted by the winners. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items. This Sweepstakes is open to legal residents of Arizona, and Prizes will only be awarded to addresses within said locations. Prizes will be picked up by each winner at On-Air Sports Marketing’s office or specific arrangements will be mutually agreed upon for each winner. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the winners. Failure to comply with the Official Rules will result in forfeiture of the prize.

Unless otherwise provided herein, no transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Allow 6-8 weeks for delivery of prizes. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE RELEASED PARTIES (AS DEFINED BELOW) HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

HOW TO ENTER

1. (a) TEXT: Listeners may enter the “FAN-TASTIC TAILGATING SWEEPSTAKES” by Texting the keyword PEAKS to 59925.
2. (b) QR Code: Use your smart phone or other web-enabled device with data plan to scan the FAN-TASTIC TAILGATING quick response (“QR”) code featured on signs and/or promotional materials referring to the Sweepstakes at participating Twin Peaks stores with the QR read application already installed on your phone. You will be directed to a mobile Web page at rocandmanuch.com/fantastic (also a “Website”). Follow the online instructions to enter and play the Sweepstakes (also a “Play”). Proof of scanning a QR code does not constitute proof of Sweepstakes.
3. To scan a QR code, Players must have a smart phone or other web-enabled device with a camera feature and/or QR scanner application and may incur message or data charges from their wireless service provider for each message sent and received. If you do not have a QR reader already installed on your phone, type ‘QR reader’ in your mobile device’s application store search field to find available QR readers for your smart phone or other web-enabled device. You will receive a response which will contain a link to download a QR reader for your specific device. Check with your wireless service provider for details on these and other applicable charges. Players are solely responsible for any such wireless charges. Not all wireless carriers participate.
4. If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. 5. There is a limit of one (1) entry per person per day (“Day”) during the Promotional Period. A “Day” is defined as a twenty-four (24) hour period beginning at 12:00:00 a.m. and ending on the same day at 11:59:59 p.m.
6. Automated entries are prohibited, and any use of automated devices will result in disqualification. No person is allowed to entry with multiple email addresses nor use any other device or artifice to enter multiple times or as multiple Players. Any person who attempts to enter with multiple email addresses, under multiple identities, or uses any device or artifice to enter multiple times will be disqualified at the Sponsor’s sole discretion. Players are not permitted to share the same email address as another Player.
7. All entries must occur during the Promotional Period. Only the methods of entry described herein are valid. No other forms of entry are valid. To be valid, each entry must comply with all instructions given to Players by Sponsor and all of these Official Rules.

Automated or robotic Entries submitted by individuals or organizations will be disqualified. Text entry must be made by the Entrant. Any attempt by an Entrant to obtain more than the stated number of Entries by using multiple/different phone numbers, email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate.

By opting in and choosing to engage in any one of our mobile messaging campaigns you are agreeing to the following Terms of Service:

Dispute Resolution: In the event that there is a dispute, claim or controversy between you and iVision Mobile, or between you and any third-party acting on behalf of iVision Mobile in connection with the Program, arising out of or relating to federal or state statutory claims, common law claims, these Terms, iVision Mobile’s Privacy Policy, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, such dispute, claim or controversy will be determined by arbitration in Los Angeles, CA before one arbitrator. The arbitration will be administered by the American Arbitration Association (“AAA”). The Consumer Arbitration Rules of the AAA in effect at the time the arbitration is commenced shall apply. The arbitrator will apply the substantive law of California, exclusive of its conflict or choice of law rules. Nothing in this paragraph will preclude the parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. The parties acknowledge that this Agreement evidences a transaction involving interstate commerce. Notwithstanding the provision in this paragraph with respect to applicable substantive law, the Federal Arbitration Act (9 U.S.C. §§ 1-16) will govern any arbitration conducted pursuant to these Terms. Either party may commence arbitration by providing the other party to the dispute a written demand for arbitration, setting forth the subject of the dispute and the relief requested (“Arbitration Demand”).

To the fullest extent permitted by law, each of the parties agrees that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than through arbitration, each party knowingly and irrevocably waives any right to trial by jury in any action, proceeding or counterclaim arising out of or relating to this Agreement or any of the transactions contemplated hereby.

The appointed arbitrator may award monetary damages and any other remedies allowed by the state law designated above. In making his or her determination, the arbitrator will not have the authority to modify any term or provision of these Terms. The arbitrator will deliver a reasoned written decision with respect to the dispute (the “Award”) to each party, who will promptly act in accordance the Award. Any Award (including interim or final remedies) may be confirmed or enforced in any court having jurisdiction, including any court having jurisdiction over either party or its assets. The decision of the arbitrator will be final and binding on the parties, and will not be subject to appeal or review. Each party will advance one-half of the fees and expenses of the arbitrator, the costs of the attendance of the court reporter at the arbitration hearing, and the costs of the arbitration facility. In any arbitration arising out of or related to these Terms, the arbitrators will award to the prevailing party, if any, costs and attorneys’ fees reasonably incurred by the prevailing party in connection with that aspect of its claims or defenses on which it prevails, and any opposing awards of costs and attorneys’ fees awards will be offset. The parties will maintain the confidential nature of the arbitration proceeding, the hearing and the Award, except as may be necessary to prepare for or conduct the arbitration hearing on the merits, or except as may be necessary in connection with a court application for a preliminary remedy, or confirmation of an Award or its enforcement, or unless otherwise required by any applicable law. Any documentary or other evidence produced in any arbitration hereunder will be treated as confidential by the parties, witnesses and arbitrators, and will not be disclosed to any third person (other than witnesses or experts), except as required by any applicable law or except if such evidence was obtained from the public domain or is otherwise obtained independently of the arbitration.

WINNER SELECTION: The winners of the Sweepstakes will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The random drawing will be conducted within five (5) business days after the Promotion Period by Administrator or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received. On-Air Sports Marketing has the right, in its sole discretion, to maintain the integrity of the contest, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses or phone numbers; multiple entries from the same computer or phone in excess of that allowed by contest rules; or the use of bots, macros or scripts or other technical means for entering. The entry must come from a person’s individual account/phone number and not a meme, community, company, animal/pet or product account. The company reserves at its sole discretion the right to choose an alternative qualifier in the event that a qualifier has been disqualified or is deemed ineligible. The company will not accept screenshots or other evidence of winning in lieu of its validation process.

WINNER NOTIFICATION: Winners will be notified via direct text message and/or phone call from On-Air Sports Marketing, sent to the Entrants’ profile used for entry, within five (5) business days after the random drawing. Potential winners must provide their contact information within 24 hours of being notified. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or winners’ failure to adequately monitor any phone messages.

PRIVACY: Any personal information supplied by you will be subject to the privacy policy of the Administrator and Partner.

TAMPERING WITH SWEEPSTAKES: Entrants found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified. Any attempt by any person to deliberately undermine the legitimate operation of the text messaging system by Ivisionmobile or Website or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and/or civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

LIMITATION OF LIABILITY: By entering, you agree to release and hold harmless On-Air Sports Marketing, Roc and Manuch with Jimmy B, Twin Peaks, additional sponsors, and each of their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not (“Released Parties”). Sponsor assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes; or (g) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserve the right at their sole discretion to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV) in a manner deemed fair and equitable by Sponsor.
